DDDStart Terms of Service
§ 1. Service provider and contact
1. The provider of the https://dddstart.com service is AMK VISION spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office in Zgorzelec, ul. Jarosława Iwaszkiewicza 18 lok. 1, 59-900 Zgorzelec, entered in the National Court Register (KRS) under number 0001137743, tax ID (NIP) 6152075857, REGON 540174839. Registry court: District Court for Wrocław-Fabryczna in Wrocław, 9th Commercial Division of the National Court Register. Share capital: PLN 5,000.
2. Contact for support, complaints and data protection matters: info@dddstart.com. Automatic notifications (e.g. confirmations, reminders, account information) are sent from powiadomienia@dddstart.com; this address is for sending only and does not accept messages, so please send questions, complaints and requests only to info@dddstart.com. The correspondence address is the same as the registered office address. The registration data was established on the basis of a National Court Register extract as of 11.10.2026.
3. The service is aimed at adult drivers on the Polish market. Contracts are concluded in Polish and prices are given in PLN. The service also serves businesses under the company offer (§ 13). Choosing an invoice when buying from a driver account turns it into a company account (§ 4(6)); this does not mean an automatic loss of the rights of an entrepreneur covered by consumer protection where the law grants them.
§ 2. Scope and technical requirements
1. The service includes an account, uploading supported DDD files, reading data, analysis, PDF reports and history. It requires an internet connection, an up-to-date browser with JavaScript and essential cookies, an e-mail address and a phone number given when creating the account. The user chooses the account language (Polish, English or Ukrainian) in which e-mails and PDF reports are sent; translations are for information only and the Polish version of the documents is binding. The file size limit is shown by the service. Not every data variant can be fully supported; limitations are indicated in the analysis result.
2. The API gives selected integrations access to the same analysis engine and balance, using separate keys and within the limits of their permissions. API access requires separate activation. The DDDStart apps for Android and iOS use the same account as the website: they allow logging in, creating an account, downloading the driver card file over Bluetooth from a supported tachograph, sending it for analysis, sending a report from the Bluetooth G2V2 diagnostic module (intended only for technical tests of the connection with the tachograph) and deleting the account. The mobile apps need an internet connection (Wi-Fi or mobile data) to work properly: it is required for logging in and creating an account, sending files for analysis, reports, purchases and account data. If the phone has no internet connection, the app says so first, when it starts, and after every loss of the connection. Without internet only the reading of the current tachograph counters (LIVE) works, provided access to it was confirmed online before; the other functions are unavailable until the connection is back. Data transmission costs are borne by the user according to their operator's tariff. Downloading in the app does not guarantee reading from every tachograph and does not replace the obligation to archive DDD files. On the Working time tab the app shows current times from the tachograph counters, and calculates compensations and the weekly rest deadline from the downloaded card file without using an analysis from the package; this calculation is not a full analysis or a PDF report and is for guidance only.
3. The marketing centre, SEO and the Google, Meta and TikTok connections are tools of the operator's administrators. They are not part of the purchased analysis, do not require connecting the driver's social media accounts and do not authorise publication of the driver's DDD file or report. An advertisement or a public guide does not constitute an individual analysis result. Access, price and order fulfilment do not depend on consent to optional marketing measurement.
§ 3. Account
1. The driver panel provides a list of matters to check after an analysis, a comparison of saved reports, the driver's own card download date and a conversation with technical support. The list of actions and the difference in counters are not individual legal advice, an inspection decision or a confirmation of compliance. A comparison requires comparable data and does not extend report retention. The driver's own download date is organisational in nature; setting it or receiving a reminder does not confirm that an obligation was fulfilled and does not replace checking the applicable requirements. The e-mail version of this reminder is optional and can be turned off independently of messages about purchases and retention.
2. Help with a report is provided through a request and a conversation in the panel; the link points to the saved report without creating an additional copy of the DDD file. The reply appears in that conversation, without being sent automatically by e-mail. The info@dddstart.com e-mail channel remains available also to persons without an account and for complaints, withdrawals and data requests. The organisational target for technical support does not change statutory deadlines.
3. The user provides true information, protects the password and uses their own account. It is not permitted to upload data without authorisation, infringe the rights of others, circumvent security measures or disrupt the operation of the service. The account is used for independent analysis by the driver.
4. The owner may delete the account themselves in the account settings on the website (https://dddstart.com/app/ustawienia#usun-konto) or in the DDD Driver Assist mobile app, after entering the password and confirming the operation. A private account with no settlements to clarify is deleted immediately and confirmed by e-mail. If the account has unused paid analyses, a pending order, a subscription or an open matter, or is a company or team account, the request goes to support: the account is deleted after settlement, no later than within 30 days, and this is confirmed by e-mail. A request can also be sent to info@dddstart.com; support will confirm identity to the extent necessary to protect data and will explain the settlement of the unused service. Deleting the account alone is not automatically a withdrawal from the contract or a refund of payment; however, it does not limit the user's statutory claims.
5. An account inactive for 12 months is automatically deleted. The period is counted from the last successful login or authenticated use of the account, including through the provided API; merely receiving messages is not activity. If there was no activity after the account was created, the period is counted from account creation. The user receives automatic warnings at the account address 30 and 7 days before the planned deletion. Renewed activity before deletion cancels the existing date and starts a new period.
6. Deleting the account covers access, files and reports and profile data, with the exceptions described in the privacy policy concerning, among other things, billing documents, claims and backups. Necessary reports should be downloaded before the deadline. Active entitlements from a later paid order are not deleted before the end of their validity because of an earlier account activity date.
§ 4. Purchase and performance of the service
1. You buy a single analysis or a package containing no more than 10 analyses. The purchase of analyses is one-off: no automatic renewal or recurring charges. A customer with an active Driver Assist subscription (§ 12) buys analyses at the subscriber price, charged per analysis, in the quantity chosen in the cart (up to 100 per order), without packages. The price list shows the number of analyses and the total gross price including taxes; the price accepted at the time of the order applies.
2. The paid contract is concluded when the order is placed with the I order with an obligation to pay button and accepted by the service, confirmed by e-mail. The terms and declarations relating to a given purchase are provided on a durable medium. The order confirmation is not a confirmation of payment or an invoice. The purchase number also identifies the order at the payment operator. After payment you receive a separate purchase confirmation; the invoice is a separate document. A copy of the terms accepted at purchase remains assigned to that order.
3. The only payment operator is Tpay (Krajowy Integrator Płatności S.A.). Available methods are shown at purchase once the integration is activated. Analyses are made available after payment is confirmed; merely returning from the operator's website does not increase the balance. A missing confirmation should be reported to the support address, giving the order number, without bank login details.
4. Unused analyses from each purchase are valid for 12 months from confirmation of its payment. A confirmed further purchase increases the balance by the analyses purchased and renews the validity of all unused, unexpired analyses for 12 calendar months from confirmation of that payment. A pending, cancelled or unpaid purchase does not extend validity. Expired analyses are not restored. We do not shorten longer deadlines or unlimited entitlements. This is not an automatic subscription or a charge for another fee. The system first uses the analyses with the nearest expiry date. Dates and the number of available analyses are shown in the account. Automatic expiry reminders are sent 30 and 7 days in advance. Expiry does not limit rights relating to a complaint, withdrawal or non-performance of the contract by the service provider.
5. The driver starts the analysis themselves by uploading a DDD file after the purchase. The result and PDF reports are made available for download in the panel. The service includes automatic analysis; an individual consultation with a person is not part of the purchase. Failure to read a file does not reduce the balance. Uploading an identical file again to the same account does not use another analysis if the record of the earlier analysis still exists. Deleting that record may mean that uploading again is a new analysis.
6. We issue invoices only to a business, from a company account with a tax ID (NIP). The user of a company account ticks the invoice option at purchase and confirms the buyer details and the e-mail address to receive it; the tax ID comes from the account details. If you tick the invoice option when buying from a driver account and enter a company name and tax ID, the account becomes a company account with these details before the order is placed. A company account cannot be linked to a company as a driver: an existing link to a company (§ 13) ends, and with it Driver Assist provided by the company. You can return to a driver account by contacting support. The details are saved with the specific order; later changes to the account settings do not change this record. Support issues the invoice in an external program and sends it separately to the given e-mail address; the dddstart application does not issue it automatically. For purchases from accounts without a tax ID we issue only a purchase confirmation, available in the panel and sent by e-mail; this does not limit rights under mandatory tax law. A purchase confirmation is available for every purchase. If the details are wrong or the document is not delivered, contact support.
7. Current prices of packages, the Driver Assist subscription and the subscriber analysis are shown in the price list on the website and in the order summary. A change of the price list does not affect orders already placed or paid.
§ 5. Meaning of the results
1. The analysis is automatic and depends on the content, completeness and recognised format of the file. Gaps in the record are not treated as rest. Variants requiring additional information are marked as conditional. The assessment of digital signatures is separate from the assessment of driving time.
2. The report presents the available information on signatures and certificates and the result of their verification. It is not a guarantee of positive verification of every file or an official certificate of authenticity. A missing signature, missing trust material or an unsupported variant is disclosed in the result. An unverified status does not prove tampering. A valid result covers only the scope of checks described in the report. The report is supporting in nature; it does not replace a decision of an authority, an individual legal assessment or the original DDD file. The amount of a potential sanction is not an imposed penalty. This information does not limit statutory liability for the conformity of the service with the contract.
§ 6. Data availability
1. The server keeps the 5 most recently uploaded original DDD files. Uploading another file automatically deletes the oldest original above this limit, and each original is deleted 3 months after its last use (uploading it again, downloading the original, opening an analysis or report from that file). After that period access to the original is blocked; a clean-up task removes it from active storage. Uploading the file again after availability has expired starts a new storage period for the original. You should keep your own copy.
2. The report and the retained analysis data are available for 12 months from creation of the analysis, unless the user deletes them earlier or the account is closed. Deleting the original DDD file does not start a new one-year report period. Downloading and viewing the report again does not extend its validity. Automatic reminders about report deletion are sent 30 and 7 days before the deadline. Further rules, data subject rights and limitations concerning copies are set out in the privacy policy. Technical interruptions or missing source data may limit the availability of functions.
§ 7. Withdrawal from the contract
1. A consumer generally has 14 days to withdraw from a contract concluded online. Requesting the service to start before the deadline does not in itself mean the loss of all consumer rights. Details and a model statement are in the document Withdrawal from the contract and complaints.
§ 8. Complaints
1. For non-conformity of a digital service with the contract, statutory remedies apply, including a demand to bring it into conformity and, in appropriate circumstances, a price reduction or withdrawal. Complaints are accepted at info@dddstart.com; the reply is provided on a durable medium within 14 days of receipt, unless a specific applicable provision states otherwise.
§ 9. Prohibited use and restriction of access
1. Do not upload files obtained unlawfully, malicious software or data you are not authorised to transfer. DDDStart does not manually check the owner of every file. The user is responsible for the accuracy of the information provided and the lawfulness of their actions; this does not transfer the service provider's legal obligations to the user.
2. Report suspected unauthorised use of data to info@dddstart.com. The service provider may restrict access to the disputed material or account to the extent necessary to clarify the matter and protect data. It informs about the reasons and the possibility of submitting explanations, unless prevented by law or a specific security threat. A restriction does not cause an automatic loss of statutory rights to a complaint or settlement.
§ 10. Changes
1. Changes to the service and terms may not deprive a consumer of statutory rights. Significant changes and their grounds will be communicated in the manner required by law before they apply. The effective date and version identifier are given above the content of the document. This version applies to orders placed from that date and does not retroactively change the terms of previously concluded contracts. A price change applies to future purchases. A change to the account rules may result from law, security or an actual change of functions; we inform about its reason and content by e-mail at least 14 days in advance, unless an absolute legal obligation or the need to remove a threat requires earlier action. The user may close the account free of charge, with statutory settlement of the unperformed service. Changes to the digital service are additionally subject to statutory conditions and rights to terminate the contract. Polish law applies, subject to mandatory consumer protection.
§ 11. Test mode and payment methods
1. Test mode is clearly marked. Payments in the simulator or sandbox do not charge the user; test purchases and balances do not constitute paid entitlements in sales mode. No real invoices are issued. Switching to sales mode does not transfer the test balance. In sales mode payments are handled exclusively by Tpay once the integration is activated. We do not accept traditional bank transfers or payments to accounts given outside the approved payment process.
§ 12. Driver Assist – monthly subscription
1. DDDStart Driver Assist is a monthly subscription to the DDD Driver Assist mobile app for Android and iOS, shared with the website account. It covers the app features described on the Driver Assist page and the right to buy DDD file analyses at the subscriber price (§ 4(1)). The subscription can be bought when the offer and recurring payment are made available in the service.
2. Before the subscription is concluded, the customer receives information on the monthly gross price in PLN, the subscriber analysis price, the number of analyses included in the month (if the offer provides for them), automatic renewal, the dates of the first and subsequent charges, the operator Tpay, how to cancel and the limitations of the Bluetooth features. The price and consent to charges require explicit confirmation; creating an account alone does not start a subscription.
3. The available method for the subscription is a recurring card payment via Tpay. Card details are entered with the operator, which carries out the required authorisation. DDDStart stores the operator's encrypted token, not the card number or CVV code. The first payment is made at purchase. The next charge is initiated one month after confirmation of the previous payment. The gross subscription price and the number of analyses included in the month are recorded at purchase; a change of the public offer does not change these terms of an existing subscription.
4. The customer can cancel further renewals in the account. The system confirms receipt of the instruction and separately reports the status of cancelling the consent with the operator. Cancellation does not automatically shorten an already paid period; the rights of withdrawal, complaint and refund are assessed independently in accordance with the law.
5. A payment, renewal or refund is not confirmed by the redirect from the gateway alone. Access is granted after server-side verification of the transaction. A payment error cannot result in a further amount being charged without appropriate authorisation.
6. Information in the app is auxiliary and does not replace the driver's legal obligations or tachograph data. The range of readings depends on the model and software of the tachograph and the phone.
7. While the subscription is active, each DDD file analysis costs the subscriber price shown in the price list, regardless of the number of analyses in the order; this price cannot be combined with discount codes or packages. The price shown when the order for analyses is placed applies. A change of the subscriber price in the price list applies to orders placed after the change. After the subscription expires, further analyses are bought under the regular package price list, and analyses already bought remain in the balance under § 4(4).
8. The subscription, its renewal, analysis packages and any other payment are purchased only on the dddstart.com website, in the Tpay gateway. The Android and iOS apps do not accept payments: the purchase button in the app opens the relevant dddstart.com page in the phone's browser. The confirmed subscription and analysis balance are assigned to the same account. Analyses included in a paid month, if the offer provides for them, increase the shared balance, carry over to subsequent months and are subject to the validity rules set out in § 4.
9. Switching off renewals in the panel stops the initiation of further charges. A transaction started before the cancellation was accepted may still be settled; the customer keeps the relevant paid period and statutory rights. An unsuccessful payment does not extend access. Where the operator's result is ambiguous, the payment requires clarification, without an automatic repeat of the charge.
10. Current tachograph counter readings in the app (LIVE) require an active Driver Assist subscription. Each user may try LIVE free of charge once, for the total number of minutes stated on the Driver Assist page and in the app; only time with an active LIVE connection counts, jointly for all phones and accounts of that user. The trial does not require card details, does not convert automatically into a paid subscription and is not renewed. Once it has been used up, LIVE requires a subscription.
§ 13. Company offer
1. The company offer is intended for businesses, in particular transport companies, concluding the contract in connection with their business activity. The company creates a company account on dddstart.com, giving the company name, tax ID (NIP) and the details of the person creating the account. It signs in to the company panel (firma.dddstart.com, a web app for phones and computers) with the same e-mail address and password as on the website. The account, package, payments and invoices are handled in the customer panel on dddstart.com; the company panel shows information about the company's drivers.
2. The package covers the company's base fee and a fee for each driver place in the chosen number, for 1 month or 12 months. Net prices, the yearly discount, the place prices depending on the number of drivers and the trial period (number of days and drivers) are shown in the price list on the website and in the order summary; VAT is added to net prices. The package does not renew automatically. During the package it can be extended for the same number of drivers; the extension runs from the end of the current package. The company chooses a different number of drivers after the package ends or by agreement with support. The order is placed and paid under § 4(2) and (3), and the invoice is issued to the company.
3. The company adds a driver in the company panel by entering their name and receives a one-time code valid for 48 hours, which it gives to the driver. The driver enters the code in the DDDStart app on their own driver account, sees the company name and the scope of sharing, and accepts the link themselves. A driver can be linked to at most one company. The driver can unlink at any time in the app, and the company can unlink the driver in the company panel. The number of linked and invited drivers does not exceed the number of places in the package or the trial period.
4. A driver linked to a company that has an active package or trial period uses Driver Assist (§ 12) without their own subscription for as long as the link and the package or trial period last. The driver account remains the driver's own account: the company has no access to their analyses, reports, balance or settings.
5. After linking, a copy of each driver card file downloaded in the app goes to the company's archive in the company panel. Sharing covers only card files, without location and without live readings. Sending a file to the company is not an analysis and does not use the balance. We keep files in the company's archive for 3 years from upload; during this time the company can download the original file at any time, one by one or as a ZIP of new files. The company may also keep the files itself: after downloading, it confirms in the company panel that it has a copy of the downloaded files, and 30 days after the confirmation we delete those files from the server. We record who confirmed and when, which files the confirmation covered and its wording. Downloading a file without confirming does not shorten the retention period. If the company gives up the service, meaning its package or trial ends without renewal or it asks for the account to be closed, it has 30 days to download the files from the archive. During this time we send reminders to the e-mail addresses of the owner and administrators of the company account: on the day the service ends, and 7 days and 1 day before deletion; the company panel shows the deletion date. After 30 days we delete the company's entire card archive. Renewing the package before that date keeps the archive. This period takes into account the transport undertaking's duty to keep data downloaded from the driver card for at least 12 months (Article 33(2) of Regulation (EU) No 165/2014) and to keep the driver's working time records for 3 years after the end of the period they cover (Article 25 of the Polish Act on drivers' working time). The company is responsible for lawful use of the files, for the legal basis for processing its drivers' data and for longer retention where the law requires it; it downloads the files it needs before the account is closed or the retention period ends.
6. As regards the card archive, the company is the controller of its drivers' data and DDDStart processes them on its behalf under the processing terms described in the Service scope information, which the company accepts together with these terms when buying a package. DDDStart processes the link data (the driver name given by the company, link status, join and leave times, number of files sent) as controller in order to provide the service to the driver and the company.
7. Consumer rights provisions do not apply to contracts under the company offer, except for rights granted by law to an entrepreneur who is a natural person where the contract is not of a professional nature for them. Complaints are accepted under § 8.
