Information about the data in DDD files

Data from DDD files and reports is not passed by the marketing module to Google, Meta or TikTok and is not used to create advertising audiences. In this module the administrator uses separate public materials; drivers' files or reports may not be added there.

A tachograph file may contain the data of several drivers, vehicle identifiers, activities, times, places, GNSS data and events. A card file contains the data saved on that card. DDDStart processes the uploaded file in order to perform the analysis and save the report in the individual account.

There is no manual verification of the owner of each DDD file. However, upload only your own files or files whose transfer you may lawfully commission. The mere technical ability to upload a file does not give the right to use other people's data. Data of recognised workshop and control cards is masked in the read representation, but remains in the unmodified original until its retention ends. The report is not public.

The server keeps the 5 most recently uploaded originals; older ones are deleted automatically, and each original 3 months after its last use (uploading it again, downloading the original, opening an analysis or report from that file). After that period reading the original is blocked and the retention task deletes the file from storage. The report and analysis data remain in the account for a maximum of 12 months from creation of the analysis, with the possibility of earlier deletion or account closure. Deleting the original does not automatically delete the data contained in the report.

If the data concerns you and the file was uploaded by another person, you can contact the controller: info@dddstart.com. Describe the matter without a password and unnecessary documents. The rules, rights, legal bases and processing periods are described in the privacy policy. We do not limit information to customers who have an account.

Controller, source, purposes and rights

The controller is AMK VISION sp. z o.o., ul. Jarosława Iwaszkiewicza 18 lok. 1, 59-900 Zgorzelec, KRS 0001137743; contact: info@dddstart.com. No data protection officer has been appointed. The source of the data is the DDD file provided by the user, not a public register. The categories include card and vehicle identifiers, activities, times, places and events, to the extent present in that file.

Analysis of the user's own data serves the performance of their contract (Art. 6(1)(b) GDPR). We process the data of other drivers in the necessary context of shared driving and record completeness, on the basis of the legitimate interest of the controller and the user in obtaining a reliable analysis (Art. 6(1)(f) GDPR). You may object on grounds relating to your particular situation.

Access is given to the authorised account user, support and the infrastructure provider within the limits of the service, and to authorities authorised by law. We do not transfer the content of DDD files to the payment operator, for invoices or to advertising platforms. Detailed rules on copies, recipients and transfers are set out in the privacy policy.

You have the rights of access, rectification, erasure, restriction, objection and, where applicable, data portability and withdrawal of consent. We generally respond within one month and inform you within that period of any permissible extension and its reasons. You may lodge a complaint with the President of the Personal Data Protection Office (UODO). The service does not take any automated decision with legal effect regarding you, does not impose penalties and does not create an advertising profile from DDD files.

Where individual notification of a person is required, the controller provides the information within the period provided for in Art. 14 GDPR, generally within one month of obtaining the data, at the latest at the first communication or disclosure of the data if these take place earlier. Applying an exception requires a separate assessment; publication of this page alone does not constitute such an exception.

Payments and driver data

For the Driver Assist subscription the only payment operator is Tpay. The payment provider receives only the data necessary for settlement and handling of the recurring consent, not DDD files, reports, detailed driving history or Bluetooth data. Changing the payment operator does not change the data source or the rules for calculating rests. Working time information requires a verified tachograph reading and a current, checked set of legal rules.

Link with a company

If you link your account to a company with a code in the app, a copy of each card file downloaded in the app goes to that company's archive. The company also sees the name it gave you, the link status, the number of files sent and the next card download date. The company does not see your analyses, reports, balance, settings, location or live readings. As regards the files in the archive, the company is the controller of your data, and DDDStart keeps them on its behalf for 3 years from upload, or 30 days after the company confirms it has its own copy of the file. If the company gives up the service, it has 30 days to download the files, after which we delete its entire card archive. This period results from the transport undertaking's duty to keep driver card data (Article 33(2) of Regulation (EU) No 165/2014) and the driver's working time records (Article 25 of the Polish Act on drivers' working time). You can unlink from the company at any time in the app; further files will then not go to the company, and the company keeps files sent earlier in accordance with the law.
