Withdrawal

A consumer who concludes a distance contract generally has 14 days to withdraw without giving a reason. For a service contract the period runs from the conclusion of the contract. It is enough to send an unambiguous statement before the period expires. The form is not mandatory.

The statement can be sent to info@dddstart.com or to the service provider's address given in the Terms of Service. Indicate the order and details that allow the contract to be identified. Do not give your password or unnecessary information about other people.

If, at the consumer's express request, the service starts before the period expires, any settlement upon withdrawal must comply with the law and the scope of the service performed. Losing the right of withdrawal after full performance of a paid service requires the statutory conditions to be met. Buying a package, logging in or downloading a single report does not by itself justify automatically excluding all rights. DDDStart does not exclude the right to withdraw from the whole package merely because a single analysis has been performed. If the service starts at the customer's express request, we settle only correctly performed analyses, in proportion to the price paid for the package. We do not charge a fee for merely creating an account or for unused analyses. If the statutory information obligations were not fulfilled or a request for earlier start was not obtained, we do not charge the customer for such a service.

Payments due are refunded without undue delay, generally within 14 days of receipt of the statement, using the same method, unless the consumer expressly agrees to another at no additional cost. The applicable law determines the permissible settlement of the service performed before withdrawal.

Buying with an invoice does not in itself exclude consumer protection. The relevant rights also apply to a natural person concluding a contract directly related to their business activity where the content shows that it is not of a professional nature for that person, to the extent provided by the Act.

A package is a one-off purchase covering up to 10 analyses valid for 12 months from confirmation of payment. The validity of the package is separate from the 14-day withdrawal period. Deleting a report or the account does not in itself constitute an unambiguous statement of withdrawal. When settling the performed part of a package we do not replace the unit price resulting from the purchase with the higher price of a single analysis outside the package. Analyses bought at the Driver Assist subscriber price are settled at the price of one analysis from the given order.

Complaints and conformity of the service with the contract

Send a complaint to info@dddstart.com. Give the order or analysis number, a description of the non-conformity and the expected resolution. If necessary, support will ask for additional information to reproduce the problem, respecting data minimisation.

Statutory remedies for digital services apply: bringing into conformity and, in the circumstances provided for by the Act, a price reduction or withdrawal. We do not limit these rights by describing the report as supporting. We reply to a consumer's complaint on a durable medium within 14 days, unless a specific provision states otherwise.

Help is available from municipal or district consumer ombudsmen and through out-of-court consumer dispute resolution. The right to go to court is preserved. After an unresolved complaint we provide, on a durable medium, information about the competent ADR entity and the statement required by law on consent to or refusal of participation. Analysis balance and buying more

A confirmed further purchase increases the balance by the analyses purchased and renews the validity of all unused, unexpired analyses for 12 calendar months from confirmation of that payment. A pending, cancelled or unpaid purchase does not extend validity. Expired analyses are not restored. We do not shorten longer deadlines or unlimited entitlements. This is not an automatic subscription or a charge for another fee. Balance validity does not change the storage periods for DDD files and reports or the consumer's statutory rights.

Driver Assist subscription – withdrawal, cancellation and refunds

Before concluding a paid subscription the customer receives separate information about the statutory right of withdrawal, its deadline, how to submit the statement and any consequences of an express request to start the service before the deadline. We do not automatically exclude the right of withdrawal just because the service is provided digitally. Every exception requires the statutory conditions to be met and appropriate information and consents.

Cancelling automatic renewal is an act separate from withdrawal from the contract and complaints. Acceptance of the instruction by DDDStart stops local scheduling of charges, but cancelling the card charge authorisation requires confirmation by Tpay. Complaints and refund requests can be sent to info@dddstart.com regardless of the availability of the payment panel. The refund will be made in accordance with the law and the procedure of the relevant operator; a refund request does not automatically mean that the operator has already returned the funds.

Withdrawal from the subscription does not automatically cancel analyses bought separately at the subscriber price; each such order is a separate contract settled under the rules of this document.
